Terms of use
Radio Mine (a MendCast service) — Terms of Use
Version of 15 October 2026
1. What Radio Mine is
Radio Mine is a technical tool and an AI-based digital control room: cloud software that provides solely the infrastructure to schedule, broadcast and deliver one's own radio (playlist, audio stream, listener app, automatic content such as traffic or weather). MendCast provides only the software tool; it is not a broadcaster, it does not select, supervise or in any way control the content uploaded, scheduled or broadcast, and it does not provide licences or authorisations of any kind.
2. The customer's sole responsibility for content and rights
Everything uploaded, scheduled, broadcast or distributed through Radio Mine (including, by way of example, music, jingles, recordings, protected works, advertising, news, programmes, voices, texts and data) is the sole responsibility of the customer who subscribed to the service and of anyone using it on the customer's behalf.
The customer represents and warrants that they are solely responsible for obtaining and maintaining, at their own expense, any licence, permit, authorisation or payment of rights required by the laws of any country in which the radio is heard or broadcast. This includes, without limitation, copyright, neighbouring rights, licences for broadcasting, streaming and communication to the public, and any other fee owed to collecting societies, producers, artists or publishers worldwide.
The customer is also solely responsible for: the compliance of broadcast advertising with applicable regulations; the news and information distributed; the consent of the people whose voice or image is reproduced; external sources connected to the system; and the processing of their listeners' data.
3. Personalisation of content in the app
The customer acknowledges and accepts that the apps and features provided by Radio Mine allow listeners to personalise their listening experience and the way they enjoy the content broadcast. The customer confirms they are aware of these features and approve their presence in the app associated with their radio.
4. Indemnity
The customer agrees to indemnify and hold harmless MendCast, its owners, collaborators and suppliers from any claim, demand for damages, penalty or expense (including legal fees) arising from the content broadcast, from the lack of licences, permits or payments of rights of any kind, or from the infringement of third-party rights or of the law by the customer or by anyone using the service on the customer's behalf.
5. Limitation of liability
The service is provided "as is" and "as available". To the maximum extent permitted by applicable law, MendCast is not liable for interruptions, delays, loss of data or listeners, lost profits or indirect damages. In any case MendCast's total liability does not exceed what the customer paid for the service in the previous twelve months. Nothing in these terms excludes consumer rights that cannot be excluded by law (for example in the European Union or under the Australian Consumer Law).
6. Disputed content
On a well-founded notice of infringement (including under the US DMCA) or an order from an authority, MendCast may suspend or remove the content or the service, informing the customer where possible.
7. Subscription, suspension and data
The service is tied to the station's licence code. If payment is missed the service may be suspended; the customer's data is kept for the period stated in the offer and becomes available again on reactivation. The customer's music folders (e.g. on Google Drive) remain the customer's: Radio Mine only reads them.
8. Changes
These terms may change; the new version must be accepted at the next login to keep using the service.
9. Governing law
These terms are governed by Italian law, without prejudice to the mandatory consumer protections of the customer's country.
10. Electronic acceptance
By ticking «I have read and accept» the customer signs these terms electronically. We record the accepted version, date and time, IP address and browser.
11. The software belongs to MendCast
Radio Mine, its code, pages, texts, working methods and design belong to MendCast and are protected by copyright and industrial property laws. The customer only receives the right to use Radio Mine for its own radio station while the subscription is active; this right may not be transferred, resold or made available to others.
It is forbidden to copy, reproduce, imitate or rebuild Radio Mine or any part of it, to try to obtain its code or internal workings (including with automated programs that read the pages), or to use what is seen in Radio Mine to build a competing service. MendCast deposits a fingerprint of its code every day with a timestamp, so it can prove at any time what it created and since when. In case of breach MendCast may suspend access immediately and claim damages.
